The European Court of Human Rights has upheld the action brought against Switzerland by the association Klimaseniorinnen: Switzerland must do more to protect the climate. Around 2,000 climate lawsuits are currently pending worldwide.
Isabelle Knoche, lawyer at KPMG Law, explains the significance of this ruling for Germany and what lessons can be learned for future climate lawsuits in the WirtschaftsWoche management blog.
The ECtHR ruling could also become very important at national level in the future. In its ruling of March 24, 2021, the Federal Constitutional Court had already called on the German legislator to define the reduction targets for greenhouse gas emissions more precisely in order to avoid possible measures that restrict the freedom of future generations.
