On 09.10.2024 (9 B 5.24), the BVerwG dismissed the appeal of the City of Kassel against the non-admission of the appeal in the judgment of the VGH Kassel of 30.11.2023 (5 A 1290/21). According to this ruling by the VGH Kassel, the water concession levy may not form part of the water charges. These decisions have significant legal and economic implications for local authorities.
